These Terms of Service (the "Terms") govern your access to and use of the Formms applications, the websites at form.ms, and the forms published through them (the "Service"). The Service permits you to create forms, publish them at a link, and collect responses.
By accessing or using the Service, you agree to be bound by these Terms and by the Privacy Policy. If you do not agree, you may not use the Service.
Formms may add, modify, or withdraw features from time to time. Certain features may be offered subject to additional terms presented in the application at the time you enable them. Where those additional terms conflict with these Terms in respect of that feature, the additional terms shall prevail for that feature only.
We may amend these Terms. We will revise the "Last updated" date above and, where a change is material, give notice in the application or by email before it takes effect, where it is practicable to do so. If you do not agree to the amended Terms, you should discontinue use of the Service. Continued use after the effective date shall constitute acceptance of the amended Terms.
You must be at least 18 years of age, and able to enter into a binding contract, in order to create a Formms account. You agree to use the Service in accordance with the laws applicable to you.
In order to use the full Service, you create an account with an email address and a password. You agree that you shall:
You are responsible for activity that occurs under your account, including activity that may follow from a lost or shared password. Where the information on an account is untrue, or where the account is misused, we may suspend or close it.
You may close your account at any time by contacting us. Closure is permanent, and you will lose access to the forms and the responses stored in the account. We may also suspend or close an account, or restrict access to the Service, where these Terms have been breached or where we consider it necessary to protect the Service or other persons. If we close a paid account, we will cease to charge fees that have not yet fallen due.
You are the form owner. A respondent is a person who submits a response to a form you have published. You are responsible for informing respondents that their answers are collected through Formms and will be handled as described in these Terms and the Privacy Policy, and for obtaining any consent that such respondents may be required to give.
Certain parts of the Service are made available without charge. Paid features, where you elect to use them, are billed at the prices displayed in the application at the time you subscribe. We may revise prices or introduce further charges, and we will notify you before any such change applies to a plan for which you are already paying. Fees already paid are not refundable, except where these Terms so provide or where applicable law requires a refund. If a payment fails, we may limit or suspend the paid portion of the Service, which may include loss of access to data that depends upon that plan.
In using the Service, you agree that you shall not:
You retain ownership of the forms you create and of the responses you collect. You grant Formms a limited, non-exclusive license to host, process, back up, and display that content solely for the purpose of providing the Service to you. You represent and warrant that you have the rights necessary to submit that content and to permit respondents to submit theirs.
We do not undertake a general obligation to monitor forms or responses. We may review, refuse, or remove content where we reasonably believe it may violate applicable law or these Terms, or where we consider it necessary to prevent fraud or abuse.
Where you use the AI assistant, it may produce a draft form from the description you provide. Any such draft is a starting point only. You remain solely responsible for reviewing and editing the draft before publication, and for the questions you ultimately ask.
The Service, including the software, the design, and the Formms name and logo, is and shall remain the property of Formms or its licensors. Nothing in these Terms conveys any right in that property other than a limited right to use the Service for so long as your account remains in good standing. You shall not copy, modify, or distribute any part of the Service except as these Terms expressly permit.
You may embed a Formms form on a site under your control, where the product so permits. A form may also contain links to third-party sites. We are not responsible for such sites, for the manner in which a host page may treat its visitors, or for any content that does not reside on Formms.
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Formms disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. You use the Service at your own risk.
To the maximum extent permitted by applicable law, Formms shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, goodwill, or data, whether arising out of or in connection with your use of, or inability to use, the Service, even where we have been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Formms from and against any claim, demand, loss, or reasonable legal expense brought by a third party and arising out of or in connection with your forms, the responses you collect, your use of the Service, or your breach of these Terms or of the rights of any other person.
