This Privacy Policy (the "Policy") sets out how Formms ("Formms", "we", "us", or "our") may collect, use, store, disclose, and protect information in connection with the Formms applications, the websites at form.ms, and the forms published through them (together, the "Service").
For the purposes of this Policy, a form owner means a person who creates an account and builds forms, and a respondent means a person who opens or submits a response to such forms. This Policy applies to both. It forms part of, and shall be read together with, the Formms Terms of Service.
Use of the Service is voluntary. You are not obliged to provide personal information, except where a feature you elect to use cannot function without it. If you do not agree to this Policy or the Terms of Service, you should not create an account, you should not submit a form, and you should cease use of the Service.
By creating a Formms account, or by otherwise accessing or using the Service, you acknowledge and agree to the collection, use, disclosure, and retention described in this Policy and in the Terms of Service.
We may amend this Policy from time to time. Where we do so, the "Last updated" date at the top of this page will be revised. If a change is material, we will give notice in the application or by email before it takes effect, where it is practicable to do so. If you do not agree to the amended Policy, you should discontinue use of the Service. Continued use after the effective date shall constitute acceptance of the amended Policy.
You may request that we provide access to, correct, delete, or restrict the processing of personal information we hold about you, by emailing [email protected]. We will respond within the time required by applicable law, and without undue delay. We will delete personal information where you so request, unless retention is required by law or the request is not technically feasible.
A respondent who seeks a copy or deletion of answers submitted through a form should, in the first instance, contact the form owner. The form owner controls the form and the responses stored in it. You may contact us where you are unable to reach the form owner, or where you believe we may be processing your information otherwise than in accordance with the form owner's instructions.
Where a person responds to a form, we collect that information on behalf of the form owner, and the form owner manages it. Formms does not determine the questions. If you have a question concerning a particular form, you should contact the person who sent it to you. That person may maintain a separate privacy notice.
We do not sell, rent, or trade a telephone number collected through a form. A telephone number is stored as part of that form's responses and is made available to the form owner who requested it.

A cookie is a small piece of data that a site may store on your browser. Formms uses only such cookies as the form itself requires:
These cookies do not execute code and do not read other sites. We do not use them for advertising. Your browser settings may block cookies. Where you do so, a form that limits responses to one per visitor may be unable to recognize a prior submission.
You may request that we close your account by emailing [email protected]. Closure of an account deletes the forms and responses held in it within a reasonable time, and you will lose access to them. You may also delete individual forms and their responses yourself while the account remains open.
We retain account, form, and response data for so long as the account remains active and the data is required to operate the Service. After an account is closed, we may retain a limited set of records where the law so requires, or where we require them to prevent fraud, to resolve a dispute, or to enforce these terms. Information so retained continues to be handled under this Policy.
Formms accounts are intended for persons who are at least 18 years of age. The Service is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child may have provided personal information to us, you may email us and we will delete it.
If you publish a form, you are responsible for the questions you ask and for the responses you receive. You should inform respondents of the manner in which you will use their answers, and you shall obtain any consent that applicable law may require. You shall not use Formms to collect sensitive information unlawfully. A respondent may request access to, or deletion of, their answers, and you are the appropriate person to address that request.
